{"id":1268,"date":"2023-02-15T07:35:00","date_gmt":"2023-02-15T06:35:00","guid":{"rendered":"https:\/\/www.vistoperitalia.it\/?p=1268"},"modified":"2026-06-15T15:16:29","modified_gmt":"2026-06-15T13:16:29","slug":"decret-flows-2023","status":"publish","type":"post","link":"https:\/\/www.vistoperitalia.it\/fr\/decret-flows-2023\/","title":{"rendered":"<strong>Voici les nouvelles concernant le d\u00e9cret Flows 2023 concernant l&#8217;embauche de travailleurs non-UE en Italie.<\/strong>"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\"><strong>Embauche de travailleurs non-UE en Italie : proc\u00e9dures et obligations pr\u00e9vues par le d\u00e9cret Flows 2023.<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le d\u00e9cret Flows 2023 r\u00e9glemente l&rsquo;entr\u00e9e des travailleurs non-UE en Italie pour l&rsquo;ann\u00e9e en cours et a \u00e9t\u00e9 publi\u00e9 au Journal officiel n\u00b0 21 le 26 janvier 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Combien de citoyens non-UE peuvent entrer en Italie pour travailler en 2023 ?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le nouveau d\u00e9cret Flows fixe une limite maximale de 82 705 entr\u00e9es, dont 44 000 sont r\u00e9serv\u00e9es \u00e0 des fins de travail saisonnier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le contingent fix\u00e9 pour les entr\u00e9es de travail non saisonnier et ind\u00e9pendant est de 38 705 unit\u00e9s, dont la grande majorit\u00e9 (30 105 unit\u00e9s) est r\u00e9serv\u00e9e aux entr\u00e9es de travail subordonn\u00e9 non saisonnier dans les secteurs du transport, de la construction, du tourisme-h\u00f4telier, ainsi que dans de nouveaux secteurs tels que la m\u00e9canique, les t\u00e9l\u00e9communications, l&rsquo;alimentation et la construction navale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En outre, une nouvelle caract\u00e9ristique importante introduite par le d\u00e9cret Flows 2022 est l&rsquo;obligation pour les employeurs de v\u00e9rifier aupr\u00e8s du Centre pour l&#8217;emploi comp\u00e9tent avant de soumettre la demande d&rsquo;autorisation de travail, afin de s&rsquo;assurer qu&rsquo;il n&rsquo;y a pas d&rsquo;autres travailleurs d\u00e9j\u00e0 disponibles sur le territoire national pour pourvoir le poste destin\u00e9 au travailleur \u00e9tranger.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cette v\u00e9rification est effectu\u00e9e en envoyant une \u00ab\u00a0demande de personnel\u00a0\u00bb au Centre pour l&#8217;emploi, en utilisant un formulaire modifiable pour v\u00e9rifier l&rsquo;indisponibilit\u00e9 de travailleurs sur le territoire national.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>La demande d&rsquo;autorisation de travail ne peut \u00eatre poursuivie que si :<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le centre d&#8217;emploi ne r\u00e9pond pas \u00e0 la demande dans les quinze jours ouvrables suivant la date de la demande ;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le travailleur signal\u00e9 par le centre d&#8217;emploi n&rsquo;est pas adapt\u00e9 au poste propos\u00e9 par l&#8217;employeur ;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le travailleur envoy\u00e9 par le centre d&#8217;emploi ne se pr\u00e9sente pas \u00e0 l&rsquo;entretien de s\u00e9lection, sauf pour une raison justifi\u00e9e, au moins vingt jours ouvrables apr\u00e8s la date de la demande.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les circonstances ci-dessus doivent \u00eatre auto-certifi\u00e9es par l&#8217;employeur et jointes \u00e0 la demande d&rsquo;autorisation de travail. Cette v\u00e9rification pr\u00e9alable de la non-disponibilit\u00e9 de travailleurs sur le territoire national n&rsquo;est pas n\u00e9cessaire pour les travailleurs saisonniers et les travailleurs form\u00e9s \u00e0 l&rsquo;\u00e9tranger.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Une autre nouveaut\u00e9 importante de cette ann\u00e9e est qu&rsquo;apr\u00e8s 30 jours \u00e0 compter de la soumission des demandes sans qu&rsquo;aucun obstacle ne soit trouv\u00e9, l&rsquo;autorisation de travail sera automatiquement d\u00e9livr\u00e9e et envoy\u00e9e aux repr\u00e9sentations diplomatiques italiennes des pays d&rsquo;origine, qui doivent d\u00e9livrer le visa d&rsquo;entr\u00e9e dans les vingt jours suivant la demande correspondante.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La v\u00e9rification des entr\u00e9es de travail subordonn\u00e9, y compris le travail saisonnier, d\u00e9j\u00e0 envoy\u00e9es aux Inspections du travail, est exclusivement d\u00e9l\u00e9gu\u00e9e aux professionnels inscrits au registre des consultants en travail, avocats ou experts-comptables et comptables.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le r\u00e9sultat de ces v\u00e9rifications sera attest\u00e9 par une d\u00e9claration appropri\u00e9e bas\u00e9e sur les lignes directrices \u00e9mises par l&rsquo;Inspection nationale du travail, qui sera jointe \u00e0 la demande d&rsquo;autorisation de travail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cette attestation n&rsquo;est pas requise dans le cas de demandes envoy\u00e9es au nom de leurs associ\u00e9s par les organisations repr\u00e9sentatives des employeurs qui ont sign\u00e9 des Protocoles d&rsquo;entente avec le minist\u00e8re du Travail et des Politiques sociales.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les organisations repr\u00e9sentatives des employeurs qui ont sign\u00e9 des Protocoles d&rsquo;entente avec le minist\u00e8re du Travail et des Politiques sociales b\u00e9n\u00e9ficieront d&rsquo;une proc\u00e9dure simplifi\u00e9e qui leur permettra de communiquer directement avec l&rsquo;Inspection du travail comp\u00e9tente les contrats de s\u00e9jour et de travail propos\u00e9s.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.vistoperitalia.it\/fr\/temoignages\/\">En lisant les nombreuses critiques que nous recevons chaque jour, vous pouvez facilement comprendre comment nous travaillons, \u00e0 quel point nos clients sont satisfaits et \u00e0 quel point nous sommes s\u00e9rieux dans notre travail.<\/a><\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img decoding=\"async\" src=\"https:\/\/www.vistoperitalia.it\/wp-content\/uploads\/2022\/12\/google-review-logo-768x316-1.png\" alt=\"google review recensioni a 5 stelle\" class=\"wp-image-1027\" width=\"373\" height=\"153\" srcset=\"https:\/\/www.vistoperitalia.it\/wp-content\/uploads\/2022\/12\/google-review-logo-768x316-1.png 768w, https:\/\/www.vistoperitalia.it\/wp-content\/uploads\/2022\/12\/google-review-logo-768x316-1-300x123.png 300w\" sizes=\"(max-width: 373px) 100vw, 373px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Du 30 janvier 2023 au 22 mars 2023, il est possible de pr\u00e9-remplir les formulaires de demande sur le portail de service du minist\u00e8re de l&rsquo;Int\u00e9rieur, accessible de 8h00 \u00e0 20h00 tous les jours de la semaine, y compris les samedis et dimanches.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les demandes doivent \u00eatre soumises \u00e9lectroniquement pour tous les types de travail subordonn\u00e9, saisonnier et non saisonnier \u00e0 partir de 9h00 le 27 mars 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les demandes peuvent \u00eatre soumises jusqu&rsquo;au 31 d\u00e9cembre 2023 ou jusqu&rsquo;\u00e0 ce que le quota disponible \u00e9tabli par le DPCM du 29 d\u00e9cembre 2022 soit \u00e9puis\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour soumettre une demande en ligne, il est n\u00e9cessaire de poss\u00e9der une identit\u00e9 SPID.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Toutes les informations concernant les d\u00e9tails et les proc\u00e9dures de soumission des demandes se trouvent dans la Circulaire interminist\u00e9rielle n\u00b0 648 du 30 janvier 2023 et la Circulaire de rectification interminist\u00e9rielle n\u00b0 732 du 1er f\u00e9vrier 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Comment puis-je convertir mon permis de s\u00e9jour ?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La conversion des permis de s\u00e9jour pour travail subordonn\u00e9 n\u00e9cessite la soumission d&rsquo;une proposition de contrat de travail sign\u00e9 par l&#8217;employeur au moment du rendez-vous avec le \u00ab\u00a0Sportello Unico\u00a0\u00bb. Cette proposition doit engager l&#8217;employeur \u00e0 embaucher le travailleur \u00e9tranger non-UE. Par la suite, la communication obligatoire de l&#8217;embauche sera g\u00e9n\u00e9r\u00e9e par le syst\u00e8me et envoy\u00e9e \u00e9lectroniquement au minist\u00e8re du Travail et des Politiques sociales.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L&rsquo;Inspection du travail territoriale est responsable de v\u00e9rifier les demandes de conversion de permis de s\u00e9jour qui impliquent l&rsquo;insertion d&rsquo;un travailleur \u00e9tranger non-UE sur le march\u00e9 national du travail, conform\u00e9ment \u00e0 l&rsquo;article 30-bis du d\u00e9cret l\u00e9gislatif 394\/1999.
